India is a Union of States
"An indestructible Union of destructible states", is what Dr. B.R. Ambedkar said about the political structure of the Government of India. The Union of India is not formed on the basis of mutual agreements between the states and as such India is following a Unitary system of governance. The states have no right to secede from the Government of India. Had the federal system of governance been followed, the states would have had all the rights to secede as they are bound by mutual agreements with the central government. It is to be understood that India is having no federal structure of governance.
The USA is an indestructible union of indestructible states, where in new states cannot be formed out of existing states or borders of existing states be altered without the consent of the states concerned. It has got a federal structure for its governance which is not the case with India.
India, that is Bharat, shall be a Union of states. [Article 1 of the Constitution of India]
Article 3 of the Indian Constitution grants Parliament the power to form new states, alter the boundaries of existing states, or change the names of existing states. This power allows the Parliament to adjust state boundaries and names through a simple majority vote, as described in Article 3 of the Constitution of India.
Article 3 in Constitution of India states so:
==Formation of new States and alteration of areas, boundaries or names of existing States==
Parliament may by law-
(a) Form a new State by separation of territory from any State or by uniting two or more States or parts of States or by uniting any territory to a part of any State;
(b) increase the area of any State;
(c) diminish the area of any State;
(d) alter the boundaries of any State;
(e) alter the name of any State;
Provided that no Bill for the purpose shall be introduced in either House of Parliament except on the recommendation of the President and unless, where the proposal contained in the B ill affects the area, boundaries or name of any of the States , the Bill has been referred by the President to the Legislature of that State for expressing its views thereon within such period as may be specified in the reference or within such further period as the President may allow and the period so specified or allowed has expired.[In article 3 of the Constitution, for the proviso, the following proviso shall be substituted through Constitution (Fifth Amendment) Act, 1955]
